In a recent development, renowned actor Jamie Foxx finds himself entangled in a legal battle as sexual assault and battery charges have been filed against him.
The lawsuit was submitted on Monday to the New York State Supreme Court, alleging an incident that took place in 2015 at the popular Catch NYC restaurant, as detailed in the obtained complaint reviewed by CNN.
Representatives for both Jamie Foxx and the plaintiff’s attorney are yet to respond to CNN’s inquiries.
The plaintiff, known as Jane Doe, asserts in the lawsuit that Foxx “intentionally and without consent used force to offensively touch Plaintiff’s person,” involving inappropriate contact with her breasts and genitals. The complaint suggests that Foxx appeared to be “intoxicated” during the incident.
According to the complaint, the woman has endured and continues to suffer from “physical and emotional injuries, anxiety, distress, embarrassment, and economic harm,” seeking an unspecified amount in damages.
Adding to the complexity of the case, the plaintiff is also holding the restaurant’s parent company, Catch Hospitality Group, and related business entities accountable. The lawsuit alleges negligent hiring, training, and supervision on their part. As of now, a representative for the company has not provided immediate comment.
This legal action comes under the purview of New York’s Adult Survivors Act, enacted in late November 2022. The legislation empowers adult survivors of sexual abuse to pursue legal action against their abusers in New York, even if the statute of limitations on their claims has lapsed. The law, set to expire on Friday, grants a one-year window for survivors to file lawsuits.
It’s worth noting that earlier this year, Foxx faced a medical episode, leading to hospitalization in Atlanta for an undisclosed condition. The Oscar-winner publicly addressed his recovery in July, marking a challenging period in both his personal and professional life.
